Update: USATF rejects deal to protect Bloomington indoor nationals

I jumped the gun earlier today in how I read a note on the USATF lawsuit. Apparently the plaintiffs offered to drop the suit contingent on USATF agreeing to a deal. But Indy balked, and the Bloomington nationals are still at risk theoretically. My apologies for not reading between the lines: “AAL representatives, including Mosbrucker, persuaded Collesano to agree with him to dismiss both of their lawsuits against Indiana USATF and USATF which included Mr. Collesano’s request for preliminary injunction that could potentially cancel the 2012 National Track and Field Masters Championship.”

The whole note from Charles Mosbrucker:

I’m writing you with an update to the ongoing litigation between USATF, Indiana USATF and its Members and Board Members.

The American Athletes League (AAL) has now become involved in an attempt to resolve the legal issues between USATF, Indiana USATF, Stanley Collesano, and Charlie Mosbrucker.

AAL representatives, including Mosbrucker, persuaded Collesano to agree with him to dismiss both of their lawsuits against Indiana USATF and USATF which included Mr. Collesano’s request for preliminary injunction that could potentially cancel the 2012 National Track and Field Masters Championship.

Part of AAL’s settlement suggestion was to have USATF assist Indiana USATF with a financial audit of the Indiana USATF books and records, and have disclosure of that financial audit be made to Indiana members. Additionally, AAL suggested that given the apparent turmoil on the Indiana USATF Board, and membership, that after results of the audit are disclosed to Indiana USATF members that the Indiana members be allowed to vote for new Board members.

Through Mosbrucker’s legal counsel, Collesano and Mosbrucker made this written offer to USATF late afternoon on February 28. By noon the next day, USATF flatly rejected their offer in an email from their attorney stating “No thanks.” No counter offer or suggestion for further discussion on the proposed resolution was offered by USATF.

AAL intends to remain diligent in its efforts to bring a conclusion to this situation in the interest of all parties involved, including the Masters athletes who plan to attend the still uncertain National Masters meet.

Later today, I got this further clarification from Charles:

Both the lawsuit requesting information form USATF and the lawsuit requesting information from INUSATF are both still pending.  The hearing for the Temporary Restraining order is still scheduled for March 9th.
